1. Acceptance of Terms

By downloading, installing, or using the ViralShot mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and ViralShot ("we," "us," or "our") regarding your use of the App and related services.

2. Description of Service

ViralShot is an AI-powered mobile application that transforms static photos into animated videos. The App uses advanced artificial intelligence and machine learning technologies to analyze images and generate motion effects.

Key features include:

• AI-powered photo animation and video generation
• Customizable video duration and quality settings
• Audio and sound effects integration
• High-definition video export capabilities
• Credit-based and subscription-based access models

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

4. Subscriptions and Payments

4.1 Subscription Plans

ViralShot offers various subscription plans and credit packages. By subscribing, you agree to pay the applicable fees as described in the App at the time of purchase.

4.2 Free Trial

We may offer a free trial period for new users. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

4.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription fee. You may cancel your subscription at any time through your device's app store settings.

4.4 Credits

Credits purchased through the App are non-refundable and non-transferable. Credits do not expire unless otherwise stated. Credits may be used to generate videos according to the pricing structure displayed in the App.

4.5 Refund Policy

All purchases are final and non-refundable except as required by applicable law. Refund requests should be directed to the app store through which you made your purchase (Google Play Store or Apple App Store).

5. User Content and Intellectual Property

5.1 Your Content

You retain all ownership rights to the photos and images you upload to the App ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your User Content solely for the purpose of providing the App's services.

5.2 Generated Videos

You own the videos generated by the App from your User Content. However, you acknowledge that the AI technology and algorithms used to create these videos are proprietary to ViralShot.

5.3 Prohibited Content

You agree not to upload or create content that:

• Violates any third-party intellectual property rights
• Contains illegal, harmful, threatening, abusive, or defamatory material
• Depicts nudity, sexually explicit content, or violence
• Promotes discrimination, hatred, or harassment
• Contains malware, viruses, or other harmful code
• Violates any applicable laws or regulations

5.4 Content Monitoring

We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable.

6. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems or software to extract data from the App
• Interfere with or disrupt the App's servers or networks
• Impersonate any person or entity or misrepresent your affiliation
• Use the App to transmit spam, chain letters, or other unsolicited communications
• Attempt to gain unauthorized access to any portion of the App
• Use the App for any commercial purpose without our express written consent

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy. By using the App, you consent to our collection and use of your data as described in the Privacy Policy.

8. AI Technology and Limitations

8.1 AI-Generated Content

The App uses artificial intelligence to generate animated videos. While we strive for high quality, AI-generated content may occasionally produce unexpected or imperfect results. We do not guarantee that every generated video will meet your expectations.

8.2 No Warranties

The App and all services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.3 Service Availability

We do not guarantee that the App will be available at all times or that it will be error-free. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ViralShot and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App.

In no event shall our total liability to you for all damages exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless ViralShot and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights

11. Third-Party Services

The App may integrate with or contain links to third-party services, websites, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

Third-party services we use include:

• Google Play Store / Apple App Store for payments and subscriptions
• Firebase for authentication and data storage
• Google Cloud Platform for AI processing

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically to stay informed of any changes.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ViralShot operates, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ViralShot regarding the App and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
